General conditions

I. PREAMBLE

These terms are concluded between Sarl TALI, registered in France, in the Lyon Register of Commerce and Companies, under N° 510 683 311, based in Caluire (France) and anyone who wishes to purchase on www.lesbebesdelysea.com, hereafter named “Internet shopper”.

The terms of sale govern the sale of the products presented on the website of:

any order implies your acceptance to the present terms of sale. The sale contract is subject to the French legislation.

The orders can be placed between the Sarl TALI and any non commercial person.

The orders can be delivered in France and overseas.

II. OFFER

our products and delivery service are subject to the prices indicated in Euros, is valid in France and abroad, and subject to stock availability.

The products offered for sale by Les bébés d’Elyséa are the ones on www.lesbebesdelysea.com on the day the internet shopper visits our web site.

Any order implies that the internet shopper agrees with the prices and descriptions of the products.

III. PRICES

Our prices are in EUR. To these prices, the internet shopper should add the delivery charge, according to the delivery fees chart (see Delivery section)

TALI (Les bébés d’Elyséa) reserves the right to change its prices at any time. The products will be invoiced at the price indicated on the day the order is placed.

Customs and taxes fees: All shipments to destinations outside of the European community may be subject to import and tax duties, which are levied by the importing country at the time the shipment arrives in the country. All applicable duties, fees and additional charges for customs clearance are responsibility of the client.

IV. ORDER

Any order placed implies that the internet shopper has accepted the prices and descriptions of the products on sale.

The internet shopper declares being aware of the present General Terms of Sale before placing the order and the validation of the order therefore implies their acceptance.

V. OFFER’S ACCEPTATION AND LES BÉBÉS D’ELYSÉA’S ORDER ACKNOWLEDGMENT

The contract is formed at the time the internet shopper receives the order acknowledgment. TALI (Les bébés d’Elyséa) also confirms your order by e-mail within 48 hours (except orders placed on Fridays, Saturdays, and French holidays).

Please retain your invoice; it will be useful in case of exchange.

VI. PAYMENT

TALI accepts payments by bank transfer, PayPal or by check. As soon as the payment has been received, we have our transport service pick up and ship your order to the desired destination. The internet shopper’s order will be considered as effective only when payment centers have given their agreement. In case of refusal, the order will automatically be cancelled. Furthermore, TALI (Les bébés d’Elyséa) reserves the right to refuse any order of a client with whom there would be a dispute.

VII. DELIVERY

The client has to check the packaging and the conformity of the products ordered, and to claim, if necessary, on the delivery note.

The risks of the transport from the departure of the company will be paid by the client.

The orders are delivered in metropolitan France (including Corsica and Monaco), and overseas.

The company TALI (Les bébés d’Elyséa) will not be responsible for delays regarding delivery times. No compensation will be accepted.

DELIVERY CHARGES

According to Colissimo prices.

For an order superior to € 50, the delivery service in France will be offered by LES BÉBÉS D’ELYSÉA.

The customer’s order will be delivered:

In France: by “La Poste” with the Colissimo service under 48 hours

In Europe: with the Colissimo service, under 4 to 6 days

Other areas: with the Colissimo service, under 5 to 10 days (different delivery times depending on countries).

TALI (Les bébés d’Elyséa) does not take responsibility for any delay in the delivery of the products.

If you are not present at the time of delivery, a notice will be left at the delivery address, indicating when and where you can collect your order.

For any delivery outside France, the goods will be delivered with the DDU Incoterm (Delivery Duty Unpaid). Therefore, the customs’ and taxes fees at the arrival in the client’s country will be paid by the client.

VIII. EXCHANGE

If you are not completely satisfied with any of our products, you can return it to us within 7 days, in its original packaging, at the following address, and we will be happy to exchange it for you:

The returned item has to be unworn and in its original packaging.

The return fees will be paid by the client.

In order to help us to improve our service, please indicate on your exchange request the reason of the return.

IX. PERSONAL DATA

The data gathered by TALI (Les bébés d’Elyséa) on www.lesbebesdelysea.com is intended only for TALI (Les bébés d’Elyséa). You can refuse your consent to this data by contacting us (TALI Sarl, Service Relations Clients, 110 Avenue du Général Leclerc, 69300 CALUIRE, FRANCE), indicating your name and address.

X. INTELLECTUAL PROPERTY

All information and elements on www.lesbebesdelysea.com are protected and are the exclusive property of the company TALI – Les bébés d’Elyséa.

A web user who has a personal website and wishes to post on its website a direct link to the Les bébés d’Elyséa homepage has to request the authorization from TALI (Les bébés d’Elyséa).

XI. INTEGRAL CLAUSE

In case one of the clauses of the present General Terms of Sale would be null and subject to legislation’s modification, this would not affect the validity and respect of the present general Terms of Sale.

XII. VALIDITY OF CONTRACT

The present General Terms of Sale remain applicable during the whole time that on-line services are provided by the company Sarl TALI - Les bébés d’Elyséa.

XIII. RESPONSIBILITY

The company Sarl TALI – Les bébés d’Elyséa cannot be liable for any inconveniences consequent to the Internet utilization.

XIV. LITIGATION

In case of dispute, an arrangement will have to be looked for before any action in court.

The present contract is governed for its interpretation and execution by the French law. Any litigation which occurs between the parties subsequent to this contract will have to be brought before the French court in Lyon, France.
